1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and BadgeFlow ("we", "us", or "our"). By accessing or using BadgeFlow, creating an account, uploading content, or using any AI features, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree, do not use the Service.

2. Service Description

BadgeFlow provides tools for creating, managing, and sharing digital badges and related media, including features powered by artificial intelligence. The quality and suitability of results may vary based on your inputs and system behavior. BadgeFlow may use third-party providers for infrastructure, storage, analytics, or other operational needs.

3. Eligibility and Account Responsibilities

  • You must be at least 18 years old (or the age of majority in your jurisdiction).
  • You must provide accurate, current, and complete information and keep it updated.
  • You are responsible for safeguarding your credentials and all activity under your account.
  • You must promptly notify us of unauthorized access or security incidents affecting your account.

4. Acceptable Use

You agree not to use the Service to create, upload, share, or distribute content that:

  • Is unlawful, promotes crime, or facilitates wrongdoing.
  • Is pornographic, sexually explicit, or exploits or endangers minors.
  • Is violent, depicts graphic harm, or promotes hate, harassment, or abuse.
  • Infringes intellectual property, privacy, publicity, or other rights of others.
  • Is deceptive (including impersonation), defamatory, or materially misleading.

You also agree not to:

  • Reverse engineer, tamper with, disrupt, or bypass access controls or usage limits.
  • Use automated means to scrape or overload the Service, except where explicitly permitted.
  • Attempt to gain unauthorized access to any accounts, systems, or networks.

5. User Content and License

You retain any rights you have in content you upload or submit to the Service ("User Content"). You represent and warrant that you have all necessary rights to submit your User Content and to grant the rights described in these Terms.

By submitting User Content, you grant BadgeFlow a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your User Content solely for the purpose of operating, maintaining, securing, and improving the Service, and providing the features you request.

6. Content Moderation and Legal Compliance

BadgeFlow may (but is not obligated to) review, moderate, remove, restrict, or disable access to User Content to enforce these Terms, protect users, prevent abuse, or comply with applicable laws.

To the extent permitted by law, we may preserve, process, or disclose User Content and related information when we reasonably believe it is necessary to comply with a legal obligation, respond to lawful requests, protect the rights and safety of BadgeFlow, our users, or the public, or investigate and prevent fraud, security, or technical issues.

7. Third-Party Services

The Service may integrate or rely on third-party services (for example, storage, analytics, or AI providers). Your use of third-party services may be subject to their separate terms and policies. BadgeFlow is not responsible for third-party services.

8. AI Output Responsibility

AI-generated content is inherently probabilistic and may be inaccurate, incomplete, stylized, or unsuitable for a particular purpose. BadgeFlow does not verify, validate, or authenticate AI outputs. You are solely responsible for how you use, publish, distribute, or rely on AI-generated content, and for ensuring compliance with applicable laws and third-party rights.

You must not use AI-generated content to impersonate, defame, mislead, or infringe the rights of others, or to make decisions where accuracy, identity verification, or professional judgment is required.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms or applicable laws, or if we reasonably believe your use poses a risk to the Service, users, or third parties. You may stop using the Service at any time.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that results will meet your expectations or that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, BadgeFlow will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where BadgeFlow is established, without regard to conflict-of-law principles. Any disputes will be brought in the competent courts of that jurisdiction, unless applicable law provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting the updated Terms through the Service. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
